Plain English Summary
Before the legal language, here's what you need to know:
- Your feeds are public. Everything you add to splicepod becomes a public RSS feed that anyone can subscribe to.
- Your email and name are in your feed. RSS feeds require author information. Your email address and name will be embedded in your public feed's XML and visible to anyone.
- This is a hobby project. One person built this for fun. There's no company, no support team, no guarantees.
- We collect minimal data. Just your name, email, and what you add to your feed. Passwords are handled by AWS Cognito—we never see them.
- You can't sue us. By using splicepod, you agree to resolve any disputes through arbitration, not courts. You also waive your right to join class action lawsuits.
- Use at your own risk. No warranties. If something breaks, we're not liable.
- Not available in the EU/EEA. If you're in the European Union or European Economic Area, you can't use this service. We don't have the resources to comply with GDPR.
If you're not comfortable with any of this, please don't use splicepod.
1. Acceptance of Terms
By accessing or using splicepod ("the Service"), you agree to be bound by this Privacy Policy and Terms of Use. If you do not agree to these terms, you must not use the Service.
2. Nature of the Service
splicepod is an independent, non-commercial project developed and maintained by an individual as a personal endeavor. The Service is not operated by a corporation, partnership, or other business entity. The Service does not retain legal counsel and is provided on a best-effort, as-available basis. By using splicepod, you acknowledge and accept these limitations.
3. Information Collection
3.1 Account Information
The Service collects the following information:
- Email address: Required for account creation and authentication. Your email address is embedded in your public RSS feed as required by the RSS specification for feed authorship.
- Name: Displayed as author attribution in publicly generated RSS feeds. Your name is embedded in your public RSS feed and visible to anyone who subscribes.
- Password: Managed exclusively through AWS Cognito; the Service does not access, process, or store passwords directly
RSS FEED DISCLOSURE: Your email address and name will be publicly visible in your RSS feed. This is a requirement of the RSS specification. Anyone who views your feed's XML source can see this information.
3.2 Identity Verification (Optional)
Users may optionally verify identity through:
- Google OAuth: Provides email address and profile name
- X (Twitter) OAuth: Provides handle and profile information
3.3 User-Submitted Content
The Service collects all content voluntarily submitted by users, including podcast episode URLs, feed names, descriptions, and any other content provided through application interfaces.
4. Use of Information
Information collected is used exclusively to create and publish publicly accessible RSS podcast feeds. User-provided names appear as feed author attribution. Email addresses are used solely for authentication. All submitted content is compiled into publicly accessible RSS feeds.
5. Public Nature of Content
ALL CONTENT SUBMITTED TO SPLICEPOD IS PUBLICLY ACCESSIBLE.
By submitting any content to the Service, you acknowledge and agree that:
- Your feed name, author name, and episode selections are publicly accessible
- Any party may access, subscribe to, and redistribute your feed
- The Service has no obligation to restrict access to your content
- You have no expectation of privacy regarding submitted content
DO NOT SUBMIT ANY CONTENT YOU DO NOT WISH TO BE PUBLICLY AVAILABLE.
6. Assumption of Risk
You expressly acknowledge and agree that your use of the Service is at your sole risk. You assume full responsibility for all risks associated with using the Service, including but not limited to:
- Loss of data or content
- Service interruptions or discontinuation
- Unauthorized access to your account
- Any consequences arising from publicly accessible content
- Interactions with third-party podcast content
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
The Service makes no warranty that:
- The Service will meet your requirements
- The Service will be uninterrupted, timely, secure, or error-free
- Results obtained from the Service will be accurate or reliable
- Any errors in the Service will be corrected
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPLICEPOD, ITS DEVELOPER, OR ANY AFFILIATED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or data
- Loss of goodwill or reputation
- Cost of substitute services
- Personal injury or property damage
- Any other intangible losses
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF SPLICEPOD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE TOTAL LIABILITY OF SPLICEPOD EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE (WHICH IS ZERO DOLLARS).
9. Indemnification
You agree to indemnify, defend, and hold harmless splicepod, its developer, and any affiliated parties from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these terms
- Your violation of any third-party rights
- Any content you submit to the Service
- Any activity under your account
10. Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
10.1 Agreement to Arbitrate
You and splicepod agree that any dispute, claim, or controversy arising out of or relating to these terms or the Service shall be resolved exclusively through final and binding arbitration, rather than in court.
10.2 Arbitration Procedures
- Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
- Arbitration shall take place in Philadelphia, Pennsylvania, or remotely at your election
- The arbitrator's decision shall be final and binding
- Judgment on the arbitration award may be entered in any court of competent jurisdiction
10.3 Exceptions
The following claims are exempt from arbitration:
- Small claims court actions (if eligible)
- Injunctive relief for intellectual property infringement
11. Class Action Waiver
YOU AND SPLICEPOD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
You expressly waive any right to:
- Participate in a class action lawsuit
- Participate in class-wide arbitration
- Participate in any consolidated or representative proceeding
If this waiver is found unenforceable, the entire arbitration agreement shall be void.
12. Third-Party Content
The Service facilitates access to podcast content hosted by third parties. Splicepod:
- Does not host, control, or endorse any podcast content
- Is not responsible for the accuracy, legality, or appropriateness of third-party content
- Makes no representations regarding third-party content
- Is not liable for any claims arising from third-party content
13. Prohibited Uses
You agree NOT to use splicepod to:
- Impersonate any person, entity, or organization
- Harass, stalk, or intimidate any individual
- Infringe on copyrights, trademarks, or other intellectual property rights
- Publish defamatory, libelous, or false statements about any person or entity
- Distribute hate speech or content that discriminates based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
- Doxx or publish private information about others without consent
- Engage in fraud or deceptive practices
- Distribute malware, viruses, or links to malicious content
- Violate any applicable laws or regulations
- Interfere with or disrupt the Service's operation
- Circumvent any security measures or access restrictions
- Scrape, harvest, or collect user data without authorization
- Use the Service for spam or unsolicited commercial communications
Violation of these terms may result in immediate termination of your account without notice. You acknowledge that splicepod has no obligation to monitor content but reserves the right to remove any content or terminate any account at its sole discretion.
14. Data Storage and Security
- Authentication credentials are managed by AWS Cognito
- User data is stored on AWS infrastructure in the United States
- All data transmission occurs over HTTPS
- The Service implements reasonable security measures; however, no system is completely secure
15. Data Retention and Deletion
- Account and feed data are retained for the duration of account existence
- Users may request account deletion, which will result in removal of associated data
- The Service may retain anonymized data for analytical purposes
- The Service reserves the right to delete accounts and data at any time without notice
16. Modification and Termination
The Service reserves the right to:
- Modify or discontinue the Service at any time without notice
- Modify these terms at any time; continued use constitutes acceptance
- Terminate or suspend your account at any time for any reason
- Delete any content at any time without notice or liability
17. Children's Privacy
The Service is not directed at individuals under 13 years of age. The Service does not knowingly collect personal information from children under 13. If you are under 13, you may not use this Service.
18. Geographic Restrictions
THIS SERVICE IS NOT AVAILABLE TO RESIDENTS OF THE EUROPEAN UNION OR EUROPEAN ECONOMIC AREA.
splicepod is not offered to, and may not be used by, residents of the European Union (EU) or the European Economic Area (EEA). By using this Service, you represent and warrant that:
- You are not located in the European Union or European Economic Area
- You are not a resident of the European Union or European Economic Area
- You will not access or use the Service while located in the EU or EEA
This restriction exists because splicepod is an independent hobby project without the resources to comply with the General Data Protection Regulation (GDPR) and related EU/EEA data protection requirements. We do not have the infrastructure, legal counsel, or operational capacity to:
- Appoint a Data Protection Officer
- Respond to data subject access requests within required timeframes
- Implement required data processing agreements
- Establish lawful bases for processing under GDPR
- Ensure compliance with cross-border data transfer requirements
If you are an EU/EEA resident and use this Service in violation of these terms, you do so at your own risk and acknowledge that you waive any rights you might otherwise have under GDPR or similar EU/EEA data protection laws.
Data Storage: All data is transferred to and stored in the United States on AWS infrastructure.
19. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles.
20. Severability
If any provision of these terms is found unenforceable, the remaining provisions shall continue in full force and effect.
21. Entire Agreement
These terms constitute the entire agreement between you and splicepod regarding the Service and supersede all prior agreements and understandings.

BY USING SPLICEPOD, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
